California Pedestrian Accidents

California is an extremely dangerous state for pedestrians. With a death and fatality rate that is about 20% higher than the national average, pedestrians are clearly at great risk in California. In 2022, California’s pedestrian deaths topped 900, which accounted for more than 15% of all pedestrian crash fatalities nationwide. These numbers may seem staggering, but they represent the reality for pedestrians in our state.

There are many factors that must be considered following a pedestrian crash. First, the circumstances of the crash must be examined. Police will look at all factors in order to determine exactly how the accident took place and who should be held responsible. A thorough investigation will be conducted, and charges may be filed. Following an investigation, victims or family members may decide to take legal action to recover their losses.

California law allows for injured victims and loved ones, in the event of a fatal crash, to bring a claim against negligent drivers. Unfortunately, many accidents are caused by careless and reckless motorists and could have been prevented through the use of ordinary care and caution.
